Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Business PowerNet (“we,” “us,” or “our”), based in Sparks, Nevada. By creating an account, starting a free trial, purchasing a subscription, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the services.

1. The Service

Business PowerNet provides access to a set of AI-powered content tools (“Tools”) that you operate yourself through an online account. Depending on your plan, the Tools may include:

  • Social Media Content Creator — generates ready-to-post captions, hashtags, and a matching image from a short brief.
  • Email Newsletter Content Creator — generates subject lines, a preview line, and a full newsletter body.
  • AI-Generated Images — generates images from a text description.
  • Audio to Text — transcribes uploaded audio or video files into text.

Additional tools, custom packages, and related digital services may be offered from time to time and are described at the point of purchase. Each Tool is subject to usage limits (for example, a number of posts, images, newsletters, or minutes of audio per period) disclosed on the pricing page or at checkout. You access and generate content through your account. Your results are shown on screen to copy, download, and use, and are also delivered to the email address on your account, so you have a ready-to-use copy in your inbox.

2. Accounts and Eligibility

You must be at least 18 years old and using the services for a business or professional purpose. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity that occurs under your account. Accounts are for a single business or individual and may not be shared or resold. Notify us promptly at support@businesspowernet.com if you believe your account has been accessed without authorization.

3. Free Trials

We may offer a free trial that lets you run a Tool a limited number of times without payment. A free trial requires a free account but no payment method, and it will not automatically convert to a paid subscription — you are only charged if you choose to subscribe. Free-trial usage is subject to the same Acceptable Use terms below, and we may limit or discontinue trials at any time.

4. Subscriptions, Billing, and Auto-Renewal

Paid plans are offered as recurring monthly subscriptions unless stated otherwise. Payments are processed securely by our payment processor, Stripe; we do not store your full card details. By subscribing, you authorize us to charge your payment method the plan price disclosed at checkout.

Your subscription automatically renews each month at the then-current price until you cancel. The billing frequency, price, and included usage limits are shown at signup and in your account. If a price changes, we will disclose the new price before it applies to a renewal.

5. Cancellation

You may cancel your subscription at any time directly from your account (via the “Manage subscription” area) — no written notice or phone call is required, and canceling is as easy as signing up. Cancellation takes effect at the end of your current billing period; you keep access until then, and you will not be billed again after that.

6. Refunds

Except where required by law, payments already processed are non-refundable, including the current subscription period after it has begun. Canceling stops future billing but does not refund the period already paid. For custom or one-time services, amounts are non-refundable once work has begun or the deliverable has been provided.

We stand behind our work. If you believe a Tool did not function as described, please contact us first at support@businesspowernet.com so we can review and resolve it before you file a dispute with your bank or card provider.

7. Acceptable Use

You are responsible for the content you generate with the Tools and for how you use it. You agree not to use the services to create, request, or distribute content that is unlawful, infringing, defamatory, hateful, harassing, sexually exploitative, deceptive, or that violates the rules of any platform on which you publish it. You agree not to attempt to circumvent usage limits, share or resell your access, reverse-engineer the services, or use them in any way that harms Business PowerNet or others. We may refuse, remove, or limit any use that violates these Terms.

8. AI-Generated Content

Content produced by the Tools is generated using artificial intelligence and may contain inaccuracies, errors, or material that is unintentionally similar to existing works. It is provided for you to review and edit — it is not professional, legal, financial, or medical advice. You are responsible for reviewing all content before publishing or relying on it, and for ensuring your use complies with applicable laws and the policies of any platform where you post it.

9. Content Ownership and License

As between you and Business PowerNet, you may use the content you generate for your own business and marketing purposes without further payment to us. Please note that, under current U.S. law, purely AI-generated material may have limited or uncertain copyright protection; we make no representation that generated content is protectable or free of third-party rights, which is why your review is important. Business PowerNet may use anonymized, non-identifying examples of generated content to demonstrate and market its services, unless you ask us in writing not to.

10. Service Availability

The services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free access. The Tools depend on third-party AI and infrastructure providers, and their outages, changes, or limits may temporarily affect availability or features. We may perform maintenance, and we may modify, suspend, or discontinue a Tool or feature, with reasonable notice where practical.

11. No Guarantee of Results

We do not guarantee any specific business outcome, engagement, follower growth, sales, or advertising performance from using the Tools or the content they produce. Results depend on many factors outside our control.

12. Limitation of Liability

To the fullest extent permitted by law, Business PowerNet is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the services or any generated content. Our total liability for any claim is limited to the amount you paid us for the specific service giving rise to the claim in the three (3) months before the claim arose.

13. Suspension and Termination

We may suspend or terminate your account or access if you violate these Terms, fail to pay, or use the services in a way that risks harm to us or others. You may stop using the services and cancel at any time as described in Section 5.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the services after an update takes effect constitutes acceptance of the revised Terms. The current version is always available at www.businesspowernet.com.

15. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Washoe County, Nevada, and you consent to their jurisdiction.

Privacy Policy

This Privacy Policy explains how Business PowerNet collects, uses, and protects information when you create an account, use our Tools, or purchase a subscription.

1. Information We Collect

  • Account and contact information you provide, such as name, business name, email address, and password.
  • Payment information, processed securely by Stripe. We do not store your full card details on our systems.
  • Content you submit to the Tools — the briefs, descriptions, prompts, notes, and audio or video files you upload to generate output.
  • Account and usage data, such as which Tools you use, your usage counts, and subscription status.
  • Technical information, such as IP address, basic device/browser data, email delivery status for troubleshooting, and cookies used to keep you logged in.

2. How We Use Your Information

  • To provide the Tools and generate the content you request.
  • To create and manage your account, process payments, and maintain order records.
  • To display your generated content on screen and deliver it to your email.
  • To communicate with you about your account, subscription, or support requests.
  • To monitor usage limits, prevent abuse, and secure the services.
  • To improve and develop our services.

3. How We Share Your Information

We do not sell your personal information. We share information only with the service providers needed to operate the business, and only to the extent needed for them to perform their function, including:

  • Stripe — payment processing.
  • Third-party AI providers (such as Anthropic and Cloudflare) — to generate content and transcriptions. The briefs, prompts, and files you submit are sent to these providers to produce your output.
  • Email delivery provider (such as Brevo) — to send account and content emails.

We may also disclose information if required by law or to protect our rights.

4. Cookies

We use cookies and similar technologies that are necessary to run the site and keep you signed in. You can control cookies through your browser, though disabling essential cookies may prevent you from logging in.

5. Data Retention

We retain your information for as long as needed to provide the services, maintain business and financial records, and comply with legal obligations. Content you generate may be stored to operate features such as your history and free-image re-rolls, and to support and troubleshoot your account.

6. Your Rights

You may request a copy of the information we hold about you, ask us to correct it, or ask us to delete it, subject to our legitimate business needs and legal record-keeping obligations. We do not sell personal information. To make a request, contact support@businesspowernet.com.

7. Security

We use reasonable administrative and technical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children

Our services are intended for business use by adults 18 and older. We do not knowingly collect information from children.

9. Changes to This Policy
